Terms and Conditions of Use and Sale

1. Acceptance and scope
These Terms govern your use of the site and the purchase of products and services offered by KOMBOA CREATIVE S.A. DE C.V. (“PalmCreating” or “the Store”). By browsing, creating an account, or placing an order, you fully accept these terms and the Privacy Policy.
2. Capacity and account
El Usuario declara tener capacidad legal para contratar. La cuenta es personal e intransferible; usted es responsable de las actividades realizadas con sus credenciales y de mantenerlas protegidas. Podemos suspender cuentas por uso indebido o riesgo de fraude.

4. Offer, prices and currency
The products/services are described in their listings with prices in local currency (MXN), unless otherwise indicated. Prices are subject to change without prior notice until you confirm your purchase. Prices include or do not include taxes as indicated at checkout.
5. Purchasing process
1. The User selects products/services and adds them to the cart.
2. Before paying, review the order summary, total amount, taxes, and terms.
3. Payment is processed through third-party processors; the order is legally confirmed upon receipt of payment authorization and validation.
4. You will receive confirmation by email with the order details and, if applicable, an electronic invoice.
6. Payment methods
Payment methods enabled on the platform are accepted. Payments are subject to anti-fraud validation; we may cancel the transaction if we detect anomalies.
7. Delivery of services
The products offered correspond to professional services and/or digital deliverables. After payment confirmation, we will contact you to schedule the kickoff, prepare a brief, and agree on deliverables and milestones. Dates and results depend on the client's timely cooperation in providing information and approvals.
8. Changes, cancellations and rescheduling
Changes in scope and rescheduling must be requested in writing at least 48 hours in advance. If the User cancels before the start of the service, refunds will be issued in accordance with the Return Policy. Once work has begun/parts have been delivered, charges may apply for hours worked, costs incurred, and/or non-refundable items for certain items.
9. Intellectual property and licenses
All content on the site and delivered parts are protected by copyright and/or industrial property rights. Unless expressly agreed upon, the client is granted a limited license to use the deliverables exclusively for the agreed-upon purposes and channels. Resale, assignment, or sublicensing is prohibited without written permission. The client warrants that they have the rights to the materials they provide to us.
10. User Conduct and Restrictions
You are prohibited from: (i) using the Site for any unlawful purpose; (ii) attempting to circumvent security measures; (iii) copying, decompiling, or creating derivative works from the Site's software; (iv) using bots or unauthorized scraping.
11. Warranties and responsibilities
The services are provided under a professional standard of care, with no guarantee of specific results unless metrics are agreed upon in the contract. To the extent permitted by law, PalmCreating shall not be liable for lost profits, indirect damages, or loss of data. The foregoing does not limit the consumer's inalienable rights established in the Federal Consumer Protection Law.
12. Consumer care and disputes
For clarifications and complaints, please contact us at comunidad@palmcreating.com. The User may contact the Federal Consumer Protection Agency (PROFECO) for conciliation. For the resolution of disputes that cannot be resolved through conciliation, the parties expressly submit to the jurisdiction and competence of the federal courts or the common courts of Mexico City, expressly waiving any other jurisdiction that may apply to them by reason of their present or future addresses.
13. Modifications
We may update these Terms; the current version is posted on the Site with its last updated date. Substantial changes will apply to new transactions upon posting.
